1. General Service Agreement

• Our company provides hosting, server, domain, SSL, email, technical support, and related technology services as a service provider and facilitator.
• By placing an order, creating an account, paying an invoice, or using our services, the customer agrees to these Terms and Conditions.
• Customers must provide accurate account, billing, contact, and ownership information during registration and service use.
• The customer is responsible for keeping all account information updated, including email address, phone number, billing details, and emergency contact information.
• We may update, modify, suspend, or discontinue any service feature when needed for security, compliance, performance, technical improvement, or business reasons.

2. Customer Responsibility for Website Security

• The customer is responsible for maintaining the security of their website, web application, CMS, plugins, themes, modules, extensions, scripts, and custom code.
• If a website is hacked because of weak coding, outdated CMS, vulnerable plugins, infected themes, weak passwords, exposed admin panels, insecure file permissions, or developer mistakes, the hosting provider will not be responsible for the damage, data loss, business loss, or service interruption.
• The customer must regularly update all technologies used on the website, including PHP version, CMS version, WordPress, Joomla, Laravel, Magento, OpenCart, WHMCS, plugins, themes, libraries, APIs, frameworks, and other third-party software.
• The customer must apply security patches, version updates, bug fixes, and vendor-recommended updates in a timely manner.
• If the customer uses a website developer, software vendor, freelancer, agency, or internal IT team, that party is responsible for developing and maintaining the website securely.
• We may provide basic guidance or support, but we are not responsible for fixing insecure source code, poor development practices, hidden malware inside uploaded files, or vulnerabilities created by the customer’s developer.
• The customer must not upload nulled scripts, pirated themes, cracked plugins, unauthorized software, or infected files to the hosting account.

3. Website Backup and Data Responsibility

• The customer is fully responsible for keeping regular backups of their website files, databases, emails, source code, configuration files, and other digital assets.
• Any backup service provided by us is an additional support facility and should not be treated as the customer’s only backup source.
• Customers should maintain their own offline backup, cloud backup, or third-party backup outside the hosting account.
• We are not responsible for data loss caused by hacking, malware, customer mistake, developer mistake, accidental deletion, wrong configuration, outdated software, compromised credentials, or third-party software failure.
• We may try to restore data from available backups when possible, but successful restoration is not guaranteed.
• Customers are strongly advised to verify their own backups regularly and keep multiple backup copies in different secure locations.

4. Server, Data Center, Rack, and Upstream Provider Limitations

• If any issue occurs due to a data center outage, rack server vulnerability, upstream network failure, power issue, hardware failure, routing issue, third-party vendor issue, or infrastructure provider problem, we will work to restore service as quickly as possible.
• However, as a middle-tier hosting service provider or facilitator, we are not responsible for losses, damages, business interruption, data loss, or financial loss caused by vulnerabilities or failures created by third-party infrastructure providers.
• We are not responsible for security incidents caused by data center-level vulnerabilities, rack server provider vulnerabilities, upstream network attacks, hardware-level issues, or third-party infrastructure compromise beyond our direct control.
• We may migrate, replace, suspend, restart, patch, or reconfigure servers when required for security, stability, compliance, or emergency maintenance.
• Customers understand that internet-based services may face downtime, attack, delay, routing failure, DDoS attack, hardware issue, software bug, or other technical problems from time to time.

5. Acceptable Use Policy

• Customers must use our services only for lawful, ethical, and permitted purposes.
• Customers must not host, upload, transmit, or distribute illegal content, phishing pages, malware, viruses, ransomware, spyware, botnet scripts, spam tools, hacking tools, stolen data, copyrighted content without permission, or any content that violates applicable law.
• Customers must not use our servers for spam, bulk unsolicited email, email spoofing, phishing, DDoS attacks, brute-force attacks, port scanning, crypto mining, proxy abuse, illegal file sharing, or abusive automation.
• Customers must not use hosting resources in a way that harms other customers, damages server performance, overloads CPU, RAM, disk I/O, database resources, email service, or network stability.
• We reserve the right to suspend or terminate any service immediately if we detect illegal activity, abuse, malware, phishing, spam, server attack, excessive resource usage, or policy violation.

6. Account Security and Login Credentials

• The customer is responsible for keeping cPanel, WHM, WHMCS, FTP, database, email, CMS, admin panel, SSH, and other login credentials secure.
• The customer must use strong passwords and should enable two-factor authentication where available.
• We are not responsible for unauthorized access caused by weak passwords, shared passwords, compromised devices, phishing, infected computers, or poor password management by the customer or their team.
• If an account is compromised, the customer must inform us immediately and take necessary steps to clean, secure, and update the affected website or application.
• We may reset passwords, suspend services, block access, or restrict features when required to protect the server and other customers.

7. Payment, Invoice, Renewal, and Suspension

• All invoices must be paid within the due date mentioned in the customer account or invoice.
• Services may be suspended automatically or manually if payment is not received by the due date.
• After suspension, service restoration may require payment of all pending invoices, late fees, reactivation fees, or other applicable charges.
• If payment remains unpaid for an extended period, the service may be terminated and data may be deleted permanently.
• The customer is responsible for renewing domains, hosting, SSL certificates, licenses, add-ons, and related services before expiration.
• We are not responsible for domain loss, website downtime, email interruption, SSL expiration, or service cancellation caused by late payment or non-renewal by the customer.

8. Refund Policy

• Refunds are only available where a refund policy is clearly mentioned for a specific service or package.
• Setup fees, domain registration fees, domain renewal fees, SSL certificate fees, software license fees, third-party fees, migration fees, and custom work fees are generally non-refundable.
• No refund will be issued if the service is suspended or terminated due to abuse, illegal activity, spam, malware, phishing, policy violation, or misuse.
• Refund requests must be submitted through the official support ticket system within the allowed refund period.
• Approved refunds may take time to process depending on the payment method, bank, gateway, or third-party processor.

9. Technical Support Scope

• We provide technical support related to hosting account access, server availability, cPanel access, basic email configuration, DNS guidance, SSL installation support, and general hosting-related issues.
• Website development, custom coding, script debugging, application bug fixing, plugin conflict fixing, theme customization, database programming, and business application troubleshooting are outside the normal hosting support scope.
• We may provide additional help for website setup, migration, malware scanning, or configuration as a courtesy or paid service, but this does not make us responsible for the customer’s website code, application security, or long-term maintenance.
• Support requests must be submitted through our official ticket system, live chat, email, or client portal.
• Support response time may vary depending on issue severity, customer package, technical complexity, and third-party provider dependency.

10. Email and Communication Policy

• Customers must not use hosting email services for spam, phishing, unsolicited marketing, abusive campaigns, or illegal communication.
• Bulk email sending is not allowed unless the service package clearly permits it and the customer follows all applicable email laws and best practices.
• Email deliverability depends on many factors, including DNS records, SPF, DKIM, DMARC, IP reputation, recipient server policy, spam filters, and customer email behavior.
• We are not responsible if third-party email providers mark emails as spam, reject emails, delay delivery, or block messages due to sender reputation, content, or recipient-side filtering.
• We may suspend email service if we detect spam, phishing, abuse, compromised mailbox activity, or blacklisting risk.

11. Domain Registration and DNS

• Domain registration, transfer, renewal, DNS management, and ownership information must follow the rules of the domain registrar and registry authority.
• The customer is responsible for providing correct domain ownership and contact information.
• We are not responsible for domain expiration, domain suspension, DNS propagation delay, wrong DNS records, registrar policy issues, registry-level restrictions, or ownership disputes caused by incorrect customer information or late renewal.
• DNS changes may take time to propagate globally, and we cannot guarantee instant DNS update across all internet providers.

12. Malware, Abuse, and Compromised Websites

• If malware, phishing, spam script, infected file, suspicious activity, or abuse is detected in any hosting account, we may suspend, quarantine, clean, restrict, or remove the affected content to protect the server and other customers.
• The customer is responsible for cleaning and securing their infected website, removing vulnerable files, updating software, and fixing the root cause of compromise.
• We may provide malware scanning or basic assistance, but complete malware removal and website hardening may require a separate paid service or a qualified security professional.
• Repeated compromise due to outdated software, insecure code, or poor maintenance may result in permanent suspension or termination of service.

13. Uptime, Maintenance, and Service Availability

• We try our best to maintain high service uptime and stable infrastructure.
• Scheduled maintenance, emergency maintenance, software updates, hardware replacement, security patches, network changes, and third-party provider maintenance may cause temporary service interruption.
• Uptime guarantee, if offered, applies only to qualifying service downtime under our direct control and does not include customer-side issues, DNS issues, third-party provider problems, cyberattacks, force majeure events, software bugs, or customer misconfiguration.
• We are not responsible for business loss, revenue loss, reputation loss, data loss, SEO impact, advertising loss, or customer claims caused by downtime or service interruption.

14. Resource Usage and Fair Use

• Hosting resources must be used fairly and reasonably according to the selected package.
• Unlimited or unmetered features are subject to fair usage, server stability, acceptable use policy, and normal website operation.
• Customers must not use shared hosting as a file storage service, backup storage, video streaming server, download mirror, mass email server, proxy server, or resource-heavy application platform unless the package clearly allows it.
• If an account causes high CPU, RAM, disk I/O, database load, email load, or network abuse, we may limit, suspend, or request an upgrade to VPS, dedicated server, or cloud server.

15. Limitation of Liability

• To the maximum extent permitted by law, we are not liable for indirect, incidental, special, financial, business, reputational, or consequential damages arising from the use or inability to use our services.
• We are not liable for losses caused by hacking, malware, customer-side vulnerability, developer mistake, third-party software issue, data center issue, rack server provider issue, upstream network issue, force majeure event, customer misconfiguration, or unauthorized access caused by compromised credentials.
• Our total liability, if any, will not exceed the amount paid by the customer for the affected service during the relevant billing period.
• The customer agrees that hosting services are technology-dependent services and may face technical risks, security risks, internet risks, and third-party dependency risks.

16. Termination of Service

• We may suspend or terminate services if the customer violates these Terms and Conditions, fails to pay invoices, abuses the service, hosts prohibited content, causes server risk, or engages in illegal activity.
• The customer may cancel services through the client area or support ticket system according to the cancellation policy.
• After termination, all files, databases, emails, backups, and account data may be deleted permanently.
• The customer is responsible for downloading and preserving their data before cancellation, suspension, or termination.

17. Changes to Terms

• We may update these Terms and Conditions from time to time to reflect service changes, legal requirements, security standards, or business policies.
• Updated terms will become effective after being published on our website or communicated through official channels.
• Continued use of our services after updates means the customer accepts the revised terms.
